DOT Drug and Alcohol Testing
Who is Tested?
CDL licensed drivers who are: (382.107) full time, part
time, casual, intermittent, leased, and independent owner-operators
who:
- Operate a motor vehicle with a GVW of 26,001 lbs. or more
- Operate a tandem motor vehicle with a trailer weight of more
than 10,000 lbs., and a combined total GVW of 26,001 lbs. or
more
- Operate a bus or other vehicle designed to transport 16 or
more passengers including the driver
- Operate a vehicle of any size that transports hazardous
materials, that requires the vehicle to be placarded in
accordance with 49 CFR part 172, subpart F
- Operate a vehicle when performing a safety sensitive
function (395.2)
What Types of Testing?
The six types of testing are:
- Pre-Employment (Currently controlled substance only)
(382.301)
- Post Accident (382.303; 390.5)
- Random (382.305)
- Reasonable Suspicion (382.307) Supervisor Training (382.603)
- Return to Duty (382.309)
- Follow-up (382.311)
Controlled substance testing is by means of a Urine Sample for:
marijuana, cocaine, opiates, amphetamines, phencyclidine. Alcohol
testing is by means of an Evidentiary Breath Alcohol Tester. Drivers
enrolled in a testing program do not require drug testing with a
physical exam.
When do Tests Occur?
Small employers (less than 50 drivers) need to begin
testing as of January 1, 1996. According to regulation, you must
have a written program in place by the start date. Testing is to be
placed throughout the year.
Testing must occur within the following guidelines:
- Post accident testing – within eight hours of the accident
- Random – must proceed immediately to the testing site within
2 hours
- Reasonable Suspicion – immediately – employer must provide
transportation
- Pre-employment testing – prior to performing safety
sensitive functions
- Return to Duty – before the employee returns to a safety
sensitive function
- Follow-up – minimum of 6 unannounced tests within 12 months
– testing may be extended to 60 months if necessary
How many are Required to Test?
Dependent on Company Policy (must be spread throughout
year)
- Alcohol random testing – minimum or 25% of eligible
employees (30-35% recommended)
- Substance abuse testing – minimum of 50% of eligible
employees (60-65% recommended)
Going above minimum is recommended to avoid coming up short at
the end of the year due to to the potential of some tests being
declared invalid.

Why is Testing Required?
Federal Mandatory Regulation Supplemented by Company Policy
- Policy must include the requirements of 382.601
- Driver must certify receipt of this information, employer
must keep certification on file.
- Drivers require training on your policy and the Federal
Regulation (382.601)
- Supervisors require training on reasonable suspicion (2
hours) (382.603)
- Independent Owner-Operators require Drug and Alcohol
familiarization training (like employee training)
